Terms of Use (EULA)

Welcome to Trackkr.app, a service provided by DTLA Professional Services, LLC ("we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of our website, mobile applications, and parcel management software (collectively, the "Service").

By registering for an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration and Security

To use Trackkr.app, you must create an account. You agree to provide accurate, complete, and updated information. You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that we suspect are compromised, fraudulent, or remain dormant for more than 60 consecutive days.

2. Permitted Use and Restrictions

You are granted a non-exclusive, non-transferable, revocable license to access and use the Service strictly for managing parcel deliveries and notifying tenants within residential or commercial properties you manage.

You agree not to:

  • Use the Service for any unlawful purpose or in violation of local, state, or international laws (including spam and telemarketing laws).
  • Attempt to bypass, exploit, or reverse-engineer our security systems, rate limits, or payment gateways.
  • Resell, sublicense, or distribute the Service to third parties without our explicit written consent.
Tenant Consent for Notifications: You represent and warrant that you have obtained the necessary, legally compliant consent from your tenants before entering their email addresses and phone numbers into the Service, specifically regarding their agreement to receive automated email and SMS text notifications.

3. Subscriptions, Payments, and Credits

Trackkr.app operates on a freemium model with optional premium upgrades and consumable SMS credit packs. We utilize a "Two-Bucket" credit system:

  • Subscriptions & Monthly Allowances: Premium plans are billed automatically on a recurring monthly basis. Any unused SMS or email credits included in your monthly Base or Premium plan do not roll over to the next billing cycle and do not accrue. They reset completely at the start of each month.
  • Purchased SMS Add-Ons: Consumable SMS credits purchased as separate "add-on packs" are non-refundable. Because these are purchased outside of your monthly allowance, they do not expire as long as your account remains active.
  • Cancellations: You may cancel your subscription at any time through your billing dashboard or App Store settings. Cancellations take effect at the end of the current billing cycle.
  • Taxes: All fees are exclusive of applicable taxes, which you agree to pay if required by your jurisdiction.

4. App Store Specific Terms (Apple & Google)

If you access the Service via a mobile application downloaded from a third-party app store, you acknowledge and agree that:

  • These Terms are concluded between you and DTLA Professional Services, LLC, not with Apple Inc. or Google LLC.
  • We are solely responsible for the Service and its content, maintenance, and support. Apple and Google have no obligation to furnish any maintenance and support services.
  • By downloading the iOS app, you also agree to the Apple Standard Licensed Application End User License Agreement (EULA).

5. Intellectual Property

All content, features, and functionality of the Service (including code, design, text, and logos) are owned by DTLA Professional Services, LLC and are protected by international copyright, trademark, and other intellectual property laws.

6. Limitation of Liability and Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

To the maximum extent permitted by law, DTLA Professional Services, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use the Service.

8. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify active users of significant changes via the email associated with their account or through an in-app alert. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
